Certain clients of Harmonic affiliates may be subject to the CCPA by virtue of being defined as a “Business” by the CCPA (“In-Scope Clients”).
Certain information received by a Harmonic affiliate in the course of performing services to an In-Scope Client may be “Personal Information” as defined by Cal. Civ. Code §§ 1798.100–1798.199 (known as the California Consumer Privacy Act of 2018).
In any such case, Harmonic shall act only as a “Service Provider” as defined by the CCPA for the purposes of its agreement with the In-Scope Client. As a Service Provider, Harmonic shall not determine the purposes and means by which the “personal information” (as defined by the CCPA) it receives pursuant to its agreement with the In-Scope Client shall be processed. In any such case, Harmonic confirms that it does not and shall not retain, use or disclose such personal information for any purpose other than for the specific purpose of performing the services specified in the agreement with the In-Scope Client or as otherwise permitted by the CCPA.
